General Terms & Conditions All-time Favourites S.L.U.

Article 1 – Definitions

In these General Terms and Conditions, unless the context indicates otherwise the following terms have the meaning ascribed to them below: 

ATF: the private limited company under Andorran law All-time Favourites S.L.U., with its registered offices at Casa 27c de la Pleta de Sant Pere, el Tarter, AD100, Canillo, Principat d’Andorra, Andorra, registered in the Andorran company register under number L-720995-Y;

Reflection period: the period of 14 (fourteen) days within which the Consumer may exercise their Right of Withdrawal or terminate the Contract without giving a reason; 

Consumer:  a natural person who is acting for purposes outside their trade, business, or profession;

Right of Withdrawal: the Consumer’s right to withdraw from the distance Contract (i.e. remote sales contract) within the Reflection Period;

Customer Service: ATF’s customer service, which can be reached at info@alltimefavourites.com;

Contract: the distance contract concluded between ATF and the Consumer through the Website based on which the Consumer purchases one or more ATF Goods;

Personal Data: any data provided by the Consumer to ATF that can be used to identify that Consumer, either directly or indirectly;

Goods: all goods AFT offers for sale to the Consumer through the Website;

Website: the website operated by ATF that can be accessed at www.alltimefavourites.com.


Article 2 – Applicability

2.1 These general terms and conditions apply to every offer made by ATF and to every Contract concluded between ATF and the Consumer.

2.2 All provisions in these general terms and conditions also apply to the legal relationship between the Consumer and any director and/or partner of ATF and/or any person employed and/or engaged by ATF.  


Article 3 – Goods 

3.1 If an offer has a limited period of validity or is made subject to conditions, this will be explicitly stated in the offer.

3.2 No rights can be derived from any misprints in the description of Goods and/or in the terms and conditions for purchasing Goods. Obvious mistakes or errors in the offer are not binding on ATF.


Article 4 – Conformity 

4.1 ATF will ensure that the Goods comply with the specifications stated in the Contract and on the Website as well as with the legal provisions and government regulations in effect on the date of delivery. 

4.2 ATF will exercise the utmost care regarding the interests of the Consumer in its performance of the Contract. In particular, ATF will ensure that the Consumer’s Personal Data is processed in accordance with the legal requirements under the General Data Protection Regulation. More information regarding this can be found in the privacy policy.

4.3 Unless expressly agreed otherwise, AFT is responsible for any damage to and/or loss of Goods up to the moment of delivery to the Consumer or to a previously designated representative of the Consumer who ATF has been notified of in advance.

4.4 The Consumer must inspect the Goods immediately on receipt and assess whether they comply with the specifications of the Contract. If this is not the case, the Consumer must contact ATF immediately so that ATF can replace the Goods if necessary.


Article 5 – Performance of the Contract

5.1 Subject to the provisions of Article 5(6) of these general terms and conditions, the Contract is concluded when the Consumer accepts the offer and meets the conditions set out in the offer, such as filling in all the required information on the Website and clicking the ‘accept’ button. These general terms and conditions and the form completed by the Consumer together set out all rights and obligations of ATF and the Consumer. 

5.2 The Consumer will ensure that all information requested by ATF or that the Consumer should reasonably be able to understand is required for the performance of the Contract is provided to ATF in good time.

5.3 If the information ATF requires for the proper performance of the Contract is not provided to ATF in good time, ATF has the right to suspend performance of the Contract.

5.4 ATF will send the Consumer confirmation of the purchase of the Goods immediately on receipt of the required information.

5.5 The Goods will be delivered to the address the Consumer has provided. The Consumer is responsible for any mistakes in the address provided and for any costs arising from such incorrect information. ATF delivers to addresses within the EU, with the exception of PO boxes.

5.6 No rights can be derived from the delivery time stated on the Website. The stated delivery time is an estimate. ATF will notify the Consumer immediately if the Goods cannot be delivered by the specified delivery time.  

5.7 ATF will deliver the Goods to the Consumer no later than 30 (thirty) days from the Contract date. If ATF is unable to deliver the Goods within 30 (thirty) days, the Consumer has the right to dissolve the Contract free of charge.

5.8 If the particular Goods are no longer available, ATF will immediately inform the Consumer and, where possible, offer replacement Goods. In this case, the Consumer has the right to dissolve the Contract free of charge.


Article 6 – Reflection period

6.1 The Consumer is entitled to a Reflection Period, that’s to say a period during which they can change their mind and withdraw from the Contract for the purchase of Goods without giving a reason for their decision. While ATF may ask the Consumer for their reason or reasons for cancelling the Contract, the Consumer is not required to state such.

6.2 The Reflection Period referred to in Article 6(1) of these general terms and conditions commences on the day after the Consumer, or a third party designated by the Consumer in advance, other than the carrier, has received the product, or;

  • if the Consumer has ordered multiple products in the same order, on the day on which the last of the Goods comes into the possession of the Consumer or a third party designated by the Consumer. ATF may refuse an order for multiple products with different delivery days and will inform the Consumer of this before the ordering process commences;

  • if the Goods forming a single item comprise multiple lots or parts, the day on which the Consumer, or a third party designated by the Consumer, receives the last lot or part;

  • for Contracts for regular delivery of Goods during a defined period of more than one day, the day on which the first of the Goods comes into the possession of the Consumer or a third party designated by the Consumer.

 

Article 7 – Obligations of the Consumer during the Reflection Period 

7.1 During the Reflection Period, the Consumer must handle the Goods and their packaging with care. The Consumer must only unpack or use the Goods to the extent necessary to check the item, its features and its operation. The basic principle in this regard is that the Consumer may only handle and inspect the Goods as they would be allowed to do in a physical shop. Tags and labels must remain attached at all times.

7.2 The Consumer is liable for any diminished value of the Goods resulting from handling the Goods in a manner that goes beyond what is permitted in accordance with Article 7(1) of these terms and conditions. ATF will not accept return of Goods where the value has been diminished through the Consumer’s handling of the Goods.

 

Article 8 – Exercising the Right of Withdrawal 

8.1 If the Consumer decides to exercise their Right of Withdrawal, they must notify ATF of their decision in an unambiguous manner before the end of the Reflection Period.

8.2 As soon as possible, and in any case within 14 (fourteen) days from the day following the notification referred to in Article 8(1) of these general terms and conditions, the Consumer must send the Goods back or hand the Goods over to ATF or an authorised representative of ATF. The Consumer will in any case be deemed to have complied with the return period conditions if they return the Goods before the end of the Reflection Period.

8.3 The Consumer must return the Goods with all accessories supplied, where reasonably possible in the original condition and packaging, and in accordance with the reasonable and clear instructions provided by ATF. 

8.4 It is the responsibility of the Consumer to prove that they have exercised their Right of Withdrawal within the specified time period and the Consumer bears the risk and costs of not doing so.

8.5 The Consumer is responsible for paying the direct costs of returning the Goods. 


Article 9 – Obligations on withdrawal

9.1 ATF will confirm receipt of the Consumer’s notification of withdrawal by email.

9.2 If the Consumer dissolves the Contract within the Reflection Period and has already paid for the Goods, ATF will refund the amount paid within 30 (thirty) days following the day on which the Consumer notifies ATF of the dissolution of the Contract. 

9.3 Unless the Consumer agrees to a different method, ATF will use the same payment method for the refund as the Consumer used to pay for the Goods. ATF will not attach charges to the refund.

9.4 If the Consumer has opted for a more expensive delivery method than the least expensive standard delivery option, ATF is not required to reimburse the additional charges for the more expensive delivery method.


Article 10 – Price

Prices shown on the website are stated in euros, including VAT, but excluding shipping costs.


Article 11 – Payment 

11.1 Unless stated otherwise in the Contract, amounts owed by the Consumer must be paid prior to delivery of the Goods.

11.2 The Consumer must immediately report any inaccuracies in payment information provided to ATF.

 

Article 12 – Personal Data and Privacy Policy

12.1 The Consumer is aware that by using the Website they are providing ATF with certain Personal Data such as their name, street address and email address. 

12.2 By agreeing to these terms and conditions, the Consumer agrees to ATF’s privacy policy as shown on the Website.


Article 13 – Complaints

13.1 Should the Consumer have a complaint regarding the Goods supplied by ATF, the Consumer must submit their complaint to Customer Service within 14 (fourteen) days of delivery of the Goods in question, providing a full, clear description of the complaint. 

13.2 ATF will respond to a complaint it receives within 14 (fourteen) days from the date of receiving the complaint. If it is expected that a longer complaint handling time will be required, ATF will respond within 14 (fourteen) days acknowledging receipt of the complaint and provide an indication of when the Consumer can expect a more detailed response.

13.3 If the complaint cannot be resolved amicably between ATF and the Consumer within a reasonable period or in any case within 3 (three) months of the date the complaint was submitted, the Consumer is entitled to bring the complaint before the competent court.  

13.4 If it emerges that a complaint is justified, the Consumer will give ATF the opportunity to properly perform the Contract. If it is no longer possible to perform the Contract in accordance with objective criteria, ATF’s liability will be limited in accordance with the provision stated in Article 14.


Article 14 – Liability

Except in the event of wilful misconduct or gross negligence on the part of ATF, ATF is not liable for any damage or loss incurred by the Consumer as a result of the Consumer’s improper or unsafe use of the Goods, including use contrary to the instructions in the accompanying user guide.


Article 15 – Changes to these general terms and conditions

ATF reserves the right to amend these general terms and conditions. 


Article 16 – Voidable or unenforceable provisions

If one or more provisions of these general terms and conditions is found to be void, voidable or otherwise unenforceable this will not affect the validity of the remaining provisions. In such a situation, ATF and the Consumer will consult with a view to agreeing a provision or provisions to replace the void, voidable or unenforceable provision(s), taking into account the purpose and intent of the original provision(s) as much as possible.


Article 17 – Governing law and jurisdiction

17.1 These general terms and conditions are effective as per 15 October 2025. 

17.2 The legal relationship between ATF and the Consumer is governed by Dutch law. All disputes between ATF and the Consumer arising from or in connection with the Contract will, in principle, be submitted to the exclusive jurisdiction of the competent court in Amsterdam.
